THE IMPACT OF INSTITUTIONS ON REGULATED AND UNREGULATED COMMODITY CIRCULATION SPHERES IN THE BREAD AND BAKERY PRODUCTS MARKET OF UKRAINE
Abstract
The article examines the impact of institutions on the development and interaction of regulated and unregulated commodity circulation spheres in the bread and bakery products market of Ukraine. The study systematizes market entities by spheres: the regulated sphere encompasses large industrial bakeries (approximately 60% of the market), mini-bakeries and individual entrepreneurs (about 10%), and retail networks with in-house production (7–12%); the unregulated sphere includes households and shadow producers (40–50% according to expert estimates). The research identifies four key interaction channels: price competition where unregulated products are offered at 25–40% lower prices, resource competition in raw materials and labor markets, consumer competition intensified by declining real incomes, and inter-sectoral migration of economic entities. The analysis reveals that formal institutions, including food safety legislation requiring Hazard Analysis and Critical Control Points system implementation, fiscal burden reaching 45–50% of value added, and the state control system weakened by the moratorium on inspections, create significant pressure on legal businesses. Informal institutions such as home baking traditions (increased from 12% to 23% of households during the war), low institutional trust levels (18–22%), and societal tolerance toward shadow activities strengthen incentives for withdrawing operations from official regulation. The study identifies critical institutional gaps: between legislative requirements and small business capabilities, between centralized regulation and regional specificity, and between declared policy goals and actual incentives of regulatory authorities. The consequences include annual tax losses of 3–5 billion Ukrainian hryvnias, distorted competition, and health risks for consumers. The article substantiates directions for improving state regulation under martial law: fiscal optimization through simplified taxation (2–3% of turnover for micro-enterprises); differentiation of regulatory requirements with simplified safety procedures for small producers; modernization of control based on risk-oriented approach and digital tools; strengthening institutional capacity through industry dialogue platforms. The proposed phased implementation accounts for wartime specifics and European integration objectives.
