ANALYSIS OF THE CURRENT STATE OF INTELLECTUAL PROPERTY MANAGEMENT IN UKRAINE: RELEVANCE AND MECHANISMS
Abstract
The article is devoted to the study of intellectual property (IP) management in contemporary business structures of Ukraine as a crucial factor in shaping enterprises’ innovative potential and competitive advantages. Intellectual property is defined as a set of intangible assets encompassing intellectual capital, rights to inventions, industrial designs, trademarks, copyright works, trade secrets, and other protected objects, as well as assets generated in the course of innovations and technological solutions, including artificial intelligence products that require specialized legal and managerial mechanisms for protection and commercialization. The current state of the Ukrainian IP market is analyzed, revealing significant fluctuations caused by wartime and economic challenges: intensive activity in the pre-war period, a sharp decline at the onset of the war, and gradual recovery following stabilization. It is established that businesses increasingly employ trademarks as a key adaptation tool, embedding IP into digital processes, marketing strategies, and the development of new services. The article examines modern challenges of IP management in the context of digitalization and artificial intelligence development, particularly issues related to algorithmic subjectivity, authorship, and the patentability of generative technologies. The study also reviews Ukrainian and international research on legal regulation, asset valuation and commercialization, integration of IP into management systems, and mechanisms for fostering innovation. A comprehensive approach to IP management is proposed, incorporating legal regulation, organizational and economic mechanisms, technological adaptation, economic incentives, strategic planning, and international integration. Supporting tables illustrate key directions of IP management, fundamental principles, processes, methods, and their practical significance for business. Systematic management of intellectual property enables resource optimization, enhances innovative activity, stimulates investment, prevents legal conflicts, and embeds IP into enterprises’ strategic development. In the current environment, IP management emerges as a strategic instrument for strengthening business competitiveness, safeguarding intangible assets, and ensuring companies’ effective adaptation to digital technologies and global market challenges.
