ADAPTING THE GERMAN PUBLIC-PRIVATE PARTNERSHIP MODEL INTO UKRAINE'S POST-WAR CRITICAL INFRASTRUCTURE RECOVERY STRATEGY: A COMPARATIVE ANALYSIS
Abstract
The article is dedicated to a study of Public-Private Partnership mechanisms as a tool for attracting private investment for the large-scale reconstruction of Ukraine during the full-scale war and the post-war period. The primary focus is on a comparative analysis of the Ukrainian regulatory and legal framework (specifically the updated 2025 legislation) and the German model of Öffentlich-Private Partnerschaft. Is substantiates the feasibility of implementing the German experience, which is characterized by a high degree of decentralization, rigorous auditing based on the «Value for Money» criterion, and the use of the Public Sector Comparator. Is discrepancied between domestic and European practices: differences in planning horizons (5–15 years in Ukraine vs. 25–30 years in Germany), discounting methods, and approaches to asset lifecycle management. The special emphasis placed on the necessity of military and political risk insurance and the mitigation of currency risks. Is examined by not only the advantages of the German model but also its potential drawbacks (high transaction costs, lengthy project preparation), which allows for the formulation of a balanced adaptation strategy. Is argued that implementing a decentralized PPP structure will empower local communities to manage critical infrastructure more effectively. The integration of advanced risk modeling is proposed to bridge the methodological gap between Ukrainian and EU investment standards. This comprehensive approach aims to transform the institutional environment for PPPs a transparent ecosystem capable of using large-scale international capital. A proposed transition from the «filling the budget gap» model to the «People-first PPP» concept (value for people). The need to create a specialized advisory body analogous to the German «Partnerschaften Deutschland» is substantiated to enhance the institutional capacity of territorial communities. Is recommended for the formation of a national PPP model capable of ensuring the effective modernization of critical infrastructure in line with EU standards.
