КЛАСИФІКАЦІЯ СПЕЦІАЛЬНИХ ОБМЕЖУВАЛЬНИХ ЗАХОДІВ (САНКЦІЙ)
Анотація
Стаття присвячена систематизації класифікації спеціальних обмежувальних заходів. Ми виділяємо та описуємо санкції залежно від об'єкта, суб'єкта накладення, латеральності, предмета, мети, масштабу, напряму впливу, рівня узагальнення, санкційної програми, сфери діяльності, рівня екстратериторіальності, зв'язку з об'єктом, суворості вимоги, санкційного правила, умов та терміну дії. Ми пропонуємо доповнити класифікацію ознаками, що відображають особливості практичної реалізації обмежень, а саме за суб'єктом реалізації державні та правоохоронні органи, суб'єкти господарювання і суб'єкти первинного фінансового моніторингу, та способом виконання моментні та постійні. Ці ознаки ми використовуємо для виявлення деяких особливостей санкцій України. Запропонована класифікація дасть змогу краще аналізувати санкційну політику через врахування як особливостей накладення, так і виконання санкцій.
